Sale of self acquired property

12-Jan-2023 (In Property Law)
I am a Hindu woman having a house in Mumbai The flat is in my name .Can I sell the flat .My son and daughter-in-law are refusing to move out though I am ready to give them alernate rental accommodation.There are quarrels between the two and there is no peace in the house.I have complained to the police about their behaviour but to no avail.How can I evict them from the flat?I had taken advice from two lawyers.One said that since it is the matrimonial home of the daughter -in-law they can't be asked to move out,the other lawyer said that since it is my property (completely financed by my husband)I can just keep their belongings out and refuse to open the door for them.Please advise.

This is my response to you:
1. Denial of access to such a shared household by any action, omission/commission, or conduct of the husband/male partner or any of his relatives is considered to be economic abuse according to the Domestic Violence Act;
2. However yours is not a shared household, thus point No.1 does not apply to you;
3. So, those houses owned by the mother-in-law i.e. you would not be a shared household;
4. Parents-in-law i.e. you have no obligation to give residence to their daughter-in-law in a house owned by you;
5. Consult a local lawyer and take steps.
