sale of property in divorce case for alimony

27-Apr-2023 (In Property Law)
there was a fathers property which was sold after his death and proceedings divided between 2 sisters and one brother. brother has purchased property from that proceedings in his name. now brother has filed a divorce and his wife asking to sell this property and pay her 50% of it as alimony. Now brother dont want to give that because he has purchased it from the sale proceeds of father's house. So no contribution from his wife at all. brother doesn't want to sell flat to settle her. what can be done?

This is my response to you:
1. Since the brother become the sole owner of the flat;
2. Then after divorce the wife is entitled to the 50% share;
3. Unless the brother proves that she is capable of earning by herself then he can refuse it;
4. The brother can also pay the rent for his wife as means of settlement of alimony;
5. Consult a local lawyer and take steps.
