Registration issue for a flat without oc

I booked a flat on jan 2013 and builder gave the possession date jan 2015. But he was unable to complete the project on time and after so many followup there was no progress. Finally I felt that builder is not showing any interest in project and ask me to go for flat registration. When i approached to bank for final disbursment bank told i have to provide the OC to bank subsequetly bank will release the fund for registration. After so much arguments with builder she told me that, she did not apply the OC till now. Now i do not understand what is solution of this problem. Please help me on this issue.
1. To get the flat registered, builder should issue OC.
2. With in the period of 3 years since possession taken, the registeration should be done.
3. I suggest you to issue legal notice to builder to issue OC. Also mention, that you may cancel the flat and go for recovery suit against builder.
