Regarding Property Inheritance

If 3 years have passed since parents death, does the property get divided equally amongst all the sons and daughters after 3 years? Is there any time limit law like this regarding property Inheritance?

Dear Sir,
I have gone through your query, daughter and wife entitled the equivalent share in deceased father property with son. Not required whether daughter performed the welfare of federal father in his life time. and they can transfer their shares to the son by exciting relinquished deed.

If the owner of the property has not left a will then the property does not get automatically divided among legal heirs. The legal heirs (sons and daughters) need to enter into a family settlement, then mutate the portions of the property in their respective names and in case the siblings are not able to come to a conclusion then a partition suit needs to be filed.

No, your husband can claim the property only if it is jointly owned and bought using the family funds Now that the Divorse Petition is filed and is pending, any purchases of movable or immovable property won't fall under the ambit of Divorse Petition.

If the mentioned residential property is self acquired property of your father then he have all the legal ownership right. Transfer of property totally depends upon your father's will. In this senario you have to prove the mental ability conditions of father on the basis of his old age. But if he is sound mind and you are major then its hard to change his mind. Its depends upon you how you convey your truthful side and message to him. But if this property is ancestral property then no transfer will happened without your permission

If you are from Hindu family you can file a civil suit for partition of all joint family properties if unequal partition is there.

if if there is a registered partition between the family you will have to challenge the deed of partition on the basis of unfairness and inequality.
