Regarding claiming my right for the ancestral property
01-Sep-2023 (In Property Law)
We are 3 siblings.me (the middle one)my brother(the eldest) and our only sister(the youngest) belonging to a hindu undivided family. My ancestral property is named after my mother after my father's demise.my elder brother decides to give all the property to his son who is the only male member among our generation.how can I claim my right for the property for me and my 2 daughters?
After the amendment act of 2005 even women have equal share in inheritance of ancestral property so if your brother has unlawfully transferred the entire property in his elder son's name then you can file a suit for cancellation of the conveyance deed and restoration of the property to its earlier position. Consequently, all the legal heirs can obtain succession certificate from the court in accordance with their share.
