Reclamation of gifted land -elderly parent from son due to abandonment

24-Nov-2023 (In Property Law)
An elderly mother (Age 80) who resides with her son had gifted her property (land) to her him since he needed the property under his name to avail loan for construction of a house on the land. The parent has a married daughter, but since the parent wanted to live with her son she had consented to gift the land to her son thereby transferring the title in his name for the sake of his son being able to avail the loan for construction on the land. The daughter didn't raise any objection for this. (Daughter is very well off). After the house has been constructed now, the son refuses to provide for his mother while asking her to leave the house. The mother has now decided to stay with her daughter's family permanently and wishes that the land be transferred back to her name.

The elderly person can lodge a complaint with the district collector and action will be taken immediately. In addition, she can file petition for maintenance before the magistrate court as she is entitled to receive maintenance from son.
