Property using with out permission

Hi,
We have given som particular amount to one of the person in 2012 for that he mortaged his property to us, after so many years also he was uanble to return our smount he said he will register his property to us which he kept us mortage, Registration done on 2016, but now he is not handovering that property to us, its his control only, we were unable to sell that property and we were unable to get that amount back, whats the solution now, pls give me some suggestion
hi you have to file a case in court stating that the property is been registered on your name as it was not against to you later on it was registered upon your name in 2016 since 2016 the previous owner is not allowing you to access the property position of it kindly give us back the position
