property sharing between children from our deceased divorced mother

My divorced mother(converted christian) has property and shares which are acquired by herself through her income and died. but she didn't write any will. is it necessary to get the succession certificate if there is no will by the deceased person ? we, myself and my sister(married) are the son and daughter of my mother. what is the percentage of the share we both (brother and sister) get separately ? what ever the percentage of share i get, can i simply give my share to my sister(married) by making a will stating that i have no objection in giving my entire share to my sister(married) which i get from my mother ? contact me G.Divakar mail id : [email protected]

as for as your query is concerned both you and your sister have right over intestate property as per the indian succession act 1925.You have to obtain succession certificate from the Court Of Law to transfer the property.
