Property ownership regarding minor
10-Aug-2023 (In Property Law)
Sir, I would respectfully like to bring your attention to my case. Sir, my father died when I was 5 and his property was then named after my grandfather with me as a minor but my grandfather passed before I was 18, so will the property treated as his and distributed according to will ?
As per the Hindu law of succession, father as well as son are class 1 legal heir but a person can obtain guardianship under order 32 of CPC during the minority of the child. So in the present case the grandfather can make a will but only in relation to his share of the property.
