Property dispute between two brothers and partition deed and possessio
26-Mar-2023 (In Property Law)
We two brothers owned and having equal share of a property with three storied building with a shopping room in front. It is inherited from grandfather by registered will and probate is granted by the competent court in the year 1984 My brother fully occupied the front shopping room and running a jewelry business, not allowing me to rise partition wall. He has occupied 70 % of residential building, not agreed for partition wall and deed, not agreed for amicable settlement, not agreed to pay reasonable costs of my share, so that I can transfer my share to him and may settle somewhere with my family. He is also very rich person and I am not. What legal action may I take ? I want to lock the shop (which is his life) can I do that legally ? Would he be able to unlock the shop with any legal order? How much time it may take to settle the case in court. What are the best way to resolve the problem ? I am anxious and afraid of his activities. I am leaving in the top floor only with my wife
the property of three stored building with a shopping room in front is inherited from your grandfather will to both of you but has the partition taken place between you both otherwise you have to file partition suit simultaneously you have to you have to file injunction so that your brother cannot part away with any portion
