I want to remove name of my wife from my property sale deed agreement as we are about to separate. agreement done in oct2015 & possession taken in aug2016. whole EMI paid from my account, wife is housewife

There are couple of ways to do this while having settlement with her you put condition to handover the title of property to you. Get the reliquishment deed executed which will make you smile woner. Else in case of dispute you can institute a civil suit for declaration and prove that she has not contributed anything to purchase property.

You can get a gift deed executed by your wife in your favour. Gift deed would attract stamp duty of ₹200/- only. The amendment was came into effect on 24th April 2015 pursuant to which stamp duty is restricted to ₹200/- only in such cases.

It is not easy to remove the name, she must release her rights from the property. Or you have to show that she is benamidar. If you are separating she can ask for the flat as a part of maintenance. A lady can claim for it.

You can remove the name from your deed and replace it with the beneficiaries. You can remove a co-owners name from your deed by signing a relinquishment or release deed. You will then be the sole owner of the house.
