Planning to take agricultural land but don't want to pay stamp duty

I m planning to purchase a agriculture land. The land is more than 200 meters away from highway. It is connected on two sides by agriculture land. There is a commercial land of other person in front of this land ,completely blocking the passage of an internal road to this khasra that I m planning to purchase . on fourth side there is govt land marked as gair mumkin rasta . then after this gair mumkin rasta there is a village pagdandi of 7 feet. The authorities are saying that they will charge stamp duty of residential area . Is this right. Can I challenge this in court.
