petrol pump license not transferred after repeated reminders

i have made full payment to the seller for petrol pump license(only) before constructing petrol pump on the land approved by company. i have power of attorney and money recieved by seller on stamp papers. but after 7 months of run. when the trasfer of license time came, he refused to transfer the license and giving my money back ( without interest and 80% money). is it possible to make him in jail and transfer the license to me. the pump has 2 partners (one seller and other) and in power of attorney only 1(seller) is mentioned another partner is in my favour i.e he is ready to transfer but seller wants to return money.
you must have entered into an agreement with the seller. Your next course of action is to be determined by the term and conditions of the agreement got entered into by you and the seller. You can also file a suit for specific performance of the agreement in the concerned court of law.
