Person promised to give land in future, took half money in advance

I bought a land (1 gunta) in 2010 form a person who said that he will be buying the land in future that he showe to us and will give us the our share of land. And we payed half the money in 2010 .Now its 7 years he have not given us land nor the money. What legal action should we take, cost and time required for justice
Law of mortgage in India regarding this is that if the person is not willing to buy back his land at the agreed consideration, the mortgagee shall have the right to sell off the land to a third party to retrieve the amount. You can also file a suit for recovery of money.
