Partition of property among two brothers

My father left us property which includes both land and house.My father died without a will. Now years after his death we want to partition for his entire property. We used the rule of family for settlement. An elder in the family was supposed to partiton the property. But the situation is we are not able to come to a settlement. Nobody aggrees on anything. Even once a settlement was made and written on blank sheet of paper(this is how partition is done in my family) and signed by all the elders of the family but few days later again the elder brother showed resentment and was no willing to accept the partition. This has led to an evergoing fight between us. How can I handle this situation legally?? Any advice would be really very helpfull. Thanks in advance.

on the above mentioned query file immediately a suit for partition in the concerning Civil Court . for the early disposal of the case both the brothers has to be appeared the time of filing of the case . at the time of hearing both are present in the court and the result is no issue notice to the defendant and the case going on with the proper proceedings .
