Partition deed between 3 brothers

Respected Sirs/Madam - My late father has a house and land which is to be shared amount 3 brothers including me. One of my brother who was financially weak wanted to make money out of the house and land, received his share in the form of cash and verbally agreed to give up his rights on the property and land. My younger brother # 3 who is abroad also agreed for the settlement and transferred the partition money. We have not made any partition deed as my younger brother is abroad and he is not expected to come to India any sooner. Is there anyway I can protect myself and my younger brother who is abroad inorder to avoid any future claims by my brother who has received the settlement? Appreciate your views.

if you need to settle your brother money in cash you can write a release deed releasing all his right in the property for the amount which you are given as consideration there is no need for a partition deed release deed can be sufficient to release his right on the father's property

By mutual consent, all brothers can file a deed of partition or suit for partition to divide property into equal portions through document verification to claim what belongs who as per Indian Law regarding property distribution between brothers.
