partion of family property between three parties where two are living

During parition with the parties in undivided property can particular rooms be legally owned while if other parties are willing to give up that part ?
In case parents are dead and two of its child are living in the property while one is living away
so while partion can one floor be named to one party and one floor to other one if all 3 parties are willing ?
During the partition suit ofcourse a settlement in whatever manner is permissible, rather it helps reaching a logical conclusion within smaller time frame. Such settlement arrived between parties should be taken down to a joint compromise petition and that should form a part of decree which will be having the equal force as the solemn order of the Court.
