Parking shed built over my flat (ground floor) in an apartment
18-Feb-2023 (In Property Law)
Hi All,
I live in a flat in an apartment community, one owner built a parking shed over my flat.
This shed touches my outer wall of flat, the made this shed by drilling outer wall of my flat (including a pillar).
I have following concerns, can i go legally over it.
- This is done with out my permission, and not even informed to the residents of apartment.
- This parking shed is just below the windows of my kitchen and dining area.
- Pigeons started making shit on the shed, above the shed we have dining and kitchen windows, if i open the window i see this shed.
- When rain falls on the shed, it making sounds, which we hear inside the home.
- This obstruct my view, previously i see the greenery below the shed now i see the shed.
- When i raised this concern to my apartment association say it is common wall, and not my wall.
- If apartment external walls are common property, then association has authority to allow the shed to a owner ?
- what if the shed rusted, looks dirty ?
no the apartment walls are not common for drilling something, so better first issue a legal notice to that person and also the association asking them to remove the said shed and make good the loss within 15 days, if they fail to do you can approach the civil court and get them removed.
