Old Original will - needed or not
11-Dec-2023 (In Property Law)
I am planning to buy a property from X. X had bought this property from Y in 2012. Y in turn had bought the property from Z in 1994. Z had got this property from his mother A as part of execution of a will executed in 1994. Now while trying to sell this property X has the original death certificate of A and a notary certified copy of the will of A. Is this sufficient or do I need to see the original will of A?
If you are buying the same extent which is shown in the WILL you definitely must have the original document with you. The certified copy of the WILL will be available only after the death of the testator. Death certificate and will is quiet necessary provided you are buying the small extent.
