Notice of subletting and rent not paid

09-Mar-2023 (In Property Law)
hi, I have a shop on rent for the last 30 years (taken by my father who is no more). I have got a notice from my landlord that I have not paid rent since last 3 years and have sublet the shop. In reality, the subletting of the shop was his idea and he was also taking share from the rent and after deducted rent, he used to give us money. Now since last two years, he has taken rent from the subtenant but has not given to us and asking us to get it to vacate. who should I do? he also mentioned to increase the rent 100% can he do that?

Hello I have perused your query. In this case you can completely deny his claim and send him a legal notice on the account of harassment. It. Is further important to know that if you are in any kind of possession in that shop be it direct or indirect .
If you are , then you can establish that you have always been the original tenant always and thus his claim is maladies.

If not , then you can establish that the said person to whom the shop was sublet was a setup by the landlord himself to dupe you to extort money. We can establish his intentions as malafide and thus we can setup a case against him for extortion and cheating .
