No Const. Started but the Builder says don't have funds.

Hi, I had booked a flat in Ghaziabad in Apr'15 by paying 10% booking amount. The scheduled delivery of the project at the time was 2018. However, over the past 2 years no construction has taken place. Hence, in Nov'16 I cancelled my booking with the builder seeking refund of my booking amount. I have been following with the Builder ever since but they have refused to refund my money citing lack of funds. I am in desperate need of funds and am really distressed. Request your support in this regards.

Hello,

You have a right to approach the consumer forum in such cases, first you will have to send the builder a legal notice, it is to be noted that the refund can only be made in terms of the buyer agreement.
