Necessity to pay 10% court fees to file a property case in court

Dear Sir, My grandfather make a will of his house in favour of my mother. But same time sister of my grandfather sell (only on 100 rupees stamp not actual registry) his portion without transfer to her name to my uncle. My lawyer said if I want to file a case against this fraud so I need to pay a court fees of 10% of price i.e. If I asume that this property sell price is 1 Cr the I need to pay 10 Laks as court fees without paying this court fees I can not file a case against this fraud. Is it true or not? While property sell only on 100 rupees stamp not actulal registry. Please help me.
For the above mentioned query the right choice is to file a case of declaration for the will. The court fees is minor i.e. 500/- (approximately) for the declaration suit.
The 100/- rs . stamp paper is a non judicial and it has not legal document for sale of the undivided property.
