My wife occupied my father's self acquired property. My father filed a Mandatory injunction suite to evict her from his house which is pending before civil court. Let me know whether the above suite is maintainable or not?. I got exparte divorce in 2016 which was appealed by my wife in high court & the same is reminded back and it is also pending in family court. Anyone please help my father who is suffering from Cancer disease & fighting with his life and want to spend his last days in his house. We belong to Hindu religion.
The suit is maintainable.
Wife do not have any right or interest over the self acquired property of in-laws.
File an application for evict her from illegal position over the prowprty.
Divorce case doesnot permit her to alinate or tresspass her in-laws self acquired property.
You can file a complaint against her fornthis also.
