I AM A RESIDENT OF DELHI.I WANT TO KNOW MY PROPERTY RIGHT.MY FATHER PASSED AWAY IN 1987,LEAVING BEHIND MY MOTHER AND ME AND MY THREE ELDER SISTERS.MY FATHER OWNED A PROPERTY IN DELHI,WHICH HAD NOT BEEN TRANSFERRED TO ANYBODY TILL DATE.HERE I WANT TO WHAT ARE MY AND MY SON'S RIGHT IN THAT PROPERTY,FOR YOUR INFORMATION MY ALL SISTERS ARE MARRIED AND ITS BEEN MORE THEN 25 YRS THAT THEY ARE MARRIED.ALL THEM ARE WELL OFF.I AM 49 AND MY SON IS 15,WHAT ARE OUR RIGHTS IN THE PROPERTY.PLEASE HELP ME REGARDING THIS.

Since your father intestate I.e., without leaving a valid Will with respect to his properties, You have to file a succession petition under section 372 of the Hindu Succession Act for the grant of succession certificate. So far as your rights with respect to the properties of your father are concerned, you are legally entitled to inherit the same. Your married sisters would not be entitled to inherit the same since the amendment in the succession actvcame in the year 2005. For further consultancy and legal services you may contact us.
