Mutation of a Registered Gift Deed, donor expired
20-Jul-2023 (In Property Law)
My mother has transferred the house property owned by her to me via a gift deed, which has already been registered at registry office by required procedure. But before mutation she expired. So now could it be processed for mutation on the basis of that registered gift deed? I have a married sister. Is any No Objection required from her?
As per your query in law rato no objection is not required from your sister as your mother already done gift deed in favour of you. But 1st class magistrate affidavit is required which should be submitted also at the time of mutation.
hello you first collect in no objection certificate from your married sister that is affidavit in first class then the affidavit alongwith registered deed xerox copy submitted to the nearest bl & ro office in your area after that a time will be given for the proceedure and then a mutation your mutation process is start. for further query you can contact me .
As the Gift Deed has already been registered therefore the death of the donor doesn't prevent you to mutate that property in your name. Your sister can't raise any objection against such mutation because then she has to file Court case for cancellation of that Registered Gift Deed.
