Mother's Gift to her daughter on her marriage which has grandmother's
21-Feb-2023 (In Property Law)
My mother wants to gift a property(House&land) to me which she got as a gift from her father legally long time back. But in that gift-deed, my grandfather included a clause that they(grandfather and grandmother) will have full rights to stay in that house till their end. Unfortunately, our grandfather is no more and a grandmother who is 84 years old now stays with her elder son at U.S.A.
My query is that, is their any legal issue for my mother to make a gift-deed on my name for the full ownership of the property, also if my grandmother has also have to sign a consent letter for which she needs to come to India for that matter.
Thanks for all who wishes to help me out. We are Hindu family based in Kerala.
Hi.. The property can be transferred to you by your mother. There is no legal issue for that. Since the clause is in that, you have to be careful while preparing the draft. It is better you can consult an advocate.
