LRF grant Land To Sc St People.
16-Mar-2023 (In Property Law)
There is a 2 acre of land which was granted to a person X belonging to SC ST in 1982 through LRF act.
After the demise of person X there children sold this land to a builder in 2011 and subsequently builder formed the layout and he sold the plots.
Now two of the children has put PTCL case in AC court to get their land back.
Is this case valid under PTCL act since this land was granted through LRF grant.? Please let me know.
If it is PTCL,the original grantee or his heirs can claim the land back after 100 years even if land has changed hands officially through Registered Sale Deeds a number of times.Strangely The Limitation Act Does not apply to this law.The current owner may have purchased it from another party and may be the third or fourth in line in which the property has changed hands. But only the current owner is expected to bear the loss of all accumulated purchases and sales International Real Estate Companies have warned about investing in Bangalore because this law does not have a Limited time period and other laws which lack clarity and need to be altered by the State Govt of Karnataka for clarity and justice.
When land is granted under PTCL act there will be conditions like 'not to alienate or sell during such period of time' ex 10/25 years depending on conditions. They can sell there land if the concerned DC has allowed permission to sell thier land. I need more details from those side you are representing.

In the context of land allocation and government schemes aimed at providing land to marginalized communities, LRF stands for "Land Rights Forum." This forum plays a crucial role in the allocation and management of land for SC/ST (Scheduled Caste/Scheduled Tribe) communities in India. Here's an explanation:
- Land Allocation to SC/ST Communities: The government of India has various schemes and policies to provide land to SC/ST communities, who have historically faced landlessness and socio-economic disadvantages.
- LRF - Land Rights Forum: The Land Rights Forum (LRF) is a platform or committee that operates at the local level, often within a revenue department or local administrative body. Its primary function is to oversee the allocation and management of land to eligible SC/ST individuals or communities.
- Role of LRF: The LRF reviews applications from SC/ST individuals or communities seeking land grants under government schemes. It ensures that the allocation is made as per the eligibility criteria and guidelines set by the government. The LRF also plays a role in addressing disputes or issues related to land allocation.
- Land Ownership and Rights: Once land is allocated to SC/ST individuals or communities through the LRF, the beneficiaries gain ownership and rights over the land. This is a significant step towards empowering marginalized communities and addressing land-related inequalities.
- Legal Aspects: The allocation of land to SC/ST communities is governed by specific laws and policies aimed at social justice and empowerment. These laws may vary from state to state.
- PTCL Act: The PTCL (Preservation of Trees in Cities of Karnataka Act) may also be relevant in the context of land allocation, particularly if it involves urban or city areas in the state of Karnataka. The PTCL Act focuses on the preservation of trees in urban areas and may have implications for land use and development.
