Loan settlement of my father who passed away
13-Sep-2023 (In Property Law)
My father passed away 2 yrs ago and he had borrowed money from a moneylender. He had provided cheque as surety for the same. Since my father passed away and there were lot of financial trouble and we are now selling father's property to settle all dues. We informed the money lender that we wish to settle his principal amount and are not in a position to pay interest dues, for which he is not agreeing on .. What are the options we have ?
You can go ahead and sell the property without consent of money lender. Since your father has passed away it will be difficult for him to recover amounts from you people or from your father's estate. Also filing a suit will be difficult for him
