Legal Right Of Mother And Wife Over Son Property
21-Jun-2023 (In Property Law)
Suppose Mr A has lot of property. Mr A has widow mother with no pension. And Mr A has a wife and minor son.
Suddenly Mr A died in accident.
Who all will be the new owner of Mr A properties?
1. Mother and wife 50/50
2. Wife
3. Mother
Note: The property is not ancestors and was purchased by Mr A himself.
No name of nominee mentioned in the documents.
The mother also succeeds to her share along with other heirs. Here the term mother also includes an adoptive mother. Moreover, if there is an adoptive mother, the natural mother has no right to succeed to the property of the intestate. A mother is also entitled to inherit the property of her illegitimate son.
That means now the property will be devolved among the mother, widow and minor son on equal share.
