My friend a UK Citizen planning to set up her medical practice here.Can she buy property in her name or would it be profitable to have it in a local Person's name (relative,etc).Kindly share the benefits, challenges and her available options.Thanks

A person resident outside India who is an NRI can purchase, any immovable property in India other than agricultural land/plantation property/farm house. Payment for acquisition of property can be made out of: a. Funds received in India through normal banking channels by way of inward remittance from any place of India or b. Funds held in any non-resident account maintained in accordance with the provisions of the Foreign Exchange Management Act, 1999 and the regulations made by Reserve Bank Of India from time to time. Such payment can not be made either by traveller’s cheque or by foreign currency notes or by other mode than those specially mentioned above. A person who is a PIO can purchse any immovable property in India other than agricultural land / farm house / plantation property:- a. By way of purchase out of funds received by way of inward remittance through normal banking channels or by debit to his NRE/ FCNR(B)/ NRO account. b. By way of gift from a person resident in India or a NRI or a PIO. By way of inheritance from any person resident in India or a person resident outside India who had acquired such property in accordance with the provisions of the foreign exchange law in force or FEMA regulations at the time of acquisition of the property.

Any immovable property could be purchased by an UK citizen in India other than any agricultural land, farm house and plantation property.

He may get any immovable property as mentioned above by gift from Indian resident, Indian citizen residing outside India or person of Indian origin.

Obtain any property by inheritance.

He could move immovable property to any resident of India by sale.

He may move any agricultural land or plantation land to any resident of India by gift.

Also he could transfer his residential or commercial property by means of gift to any person either residing in India or abroad or person of Indian origin
