Leave & Licence Deposit Amount returend

Dear sir, i had given property (Commercial + Residential buildings) on leave and licence basis to one Mr 'X' in October 2017 for period of 3 years as per "Maharashtra Rent Control act." There is a Registered document between Licensor and Licensee with clause of monthly Licence fees and Interest free deposit etc. and deposit to be refunded on expiry of agreement. Deposit amount has been refunded to licensee's as per his demand by DD/ Managers cheques. But licensee not vacating premises and is just paying licence fees and that to 2 months late. Notice has been served on 24 Jan 2019 to licensee saying that if the licensee requires premises for further period fresh Agreement to be executed with fresh terms and conditions along with Deposit. "There is no reply form licensee till date. question:- 1) do i have to file eviction petition? 2) are there any citations/ rules concerned to this particular issue? what would be the merits of such case.

hello Aishwarya Korea mention about the fact that the licensee has been continued to staying in the licence premises after the expiration of the licence period dear if slicer speed is expired and he is not affecting the licence premises then you are file eviction Suit against him since you already paid his security deposit
