Is Mutation is necessary by legal heir before sale of land

A sold a land to me in 1985 which was in name of his father who died in 1975. There were only 2 legal heir A & B. A sold 50 percent of total land which was ultimately his share.. But main issue is that A has not done the mutation and just produce affidavit before SDM and sold the land . Now other legal heir claims that sale deed was illegal on ground that mutation not take place..

This is my response to you:
1. The sale is never complete until the mutation entry is done in the land records department;
2. You can search for A and make him register the land in your name;
3. Send him a legal notice if he refuses to come forward;
4. If B troubles you then take A and B to court and claim injunction;
5. Consult a local lawyer and take steps.
