Is cancellation of a release deed possible if it is related to blind
27-Sep-2023 (In Property Law)
My father's sister had good vision while signing release deed and later she became blind and now she sent notice to us that we we made her believe it was some other document and she states that since she is uneducated she was signed in documents without knowing it was release deed .
In this case
1) we have proper release deed documents ( is this enough to prove )
2) does she have any benefit because she is blind now ?
3) my father has two more sister s ( if anyone stand by blind person for fake evidence is it possible to win the case ?
4) what kind of evidence do we need for this other than release deed?
You need to issue a reply notice citing that he was not incapacitated at the time of execution of release deed. Relevant facts and circumstances need to be looked into inorder to draft a befitting reply. Any kind of evidence to be adduced would be subject to trial. Destruction of evidence can be that stage and they will be exposed at the stage of trial.
