Indian succession act, christain family flat transfer

Can a judge refuse to follow indian succession act in case of a Christian family, the deseased is a Christian and so is his family. However when asked he said that class 1 legal heirs will get the share of flat which includes the deseased persons mother. Is he right is doing so in navi mumbai? Is there any way out?
This is my response to you:
1. If there is inter religious marriage then the court should adopt indian succession act;
2. The court should not adopt hindu succession act;
