21-Jun-2023 (In Property Law)
1) Mr. bharu get agricultural land from land owner, before 1950. Then pass on to shripati then pass on to sopan then pass on ram/shyam & manju & anju & after that respectively predecessor which is alive. now their(ram/shyam) successor telling that we daughters manju & anju predecessor, doesn’t have equal right or any right in property. query:- A) Property is ancestor or property loose ancestor value. if partition is demanded by anju & manju predecessor. beacuse it come from. 1) Mr.bharu (male)died 2) mr.shripati (male)died 3) mr. sopan (male)died before2005 4)ram & shyam (males) anju & manju both married (females) they all died before 2005 B) how much or how share is defined if it is ancestor property or non-ancestor property
In the given situation, it is not clear as to whether the said property was transferred among the successors of a family and if it is so, then the said property will be considered as ancestral but, the said manju and anju cannot claim their share as their father died before 2005.
