I face a property matter. What are my legal options

My late father had sold a property to his brother son on promise of Rs 5,00,000 and recieved only Rs 2,50,000 as intail payment balance to settled in one year and The property agreement made was within 1 year if the balance is not settled the property will return to it old owner and even after my father death now 1 year money balance has not being recieved by his his heir the son who is heir has not signed or given his consent in any of the property papers as such and at time time of my father death he has told me you can give a stay notice and tell the person to return back the land Tell is it possible for me to case if I go for a stay notice as a son of my late father

Sir, It is the problem for both of the parties, in case if any one of the party dies. Is the late person left any Will? . Once the person dies the agreement whatever he made become 'void' unless it is re-written according to his/her legal heir. So, The agreement must be re-written now. It need more discussion.
