How to get refund from builder due to not receiving possession?

We buyed a shop in a shopping plaza around 4 years back , till now its not yet completed or given possession , so we asked builder to return the money back , he agreed to it but he is delaying or not refunding after several follow ups , the builder is delhi based and has a registered office in delhi, we paid the full amount through cheque only. Please suggest in this case what are the options to get the money back from him .
or this we need to look at the documents as to what was the stipulated time promised by the builder to hand over the possession. Nevertheless in case the period promised by the builder to hand over the possession had already expired then you can file a suit for specific performance of the contract as well as suit for damages for the financial losses incurred by you due to non-delivery of the possession.
You can also file a complaint in the consumer forum against the builder for deficiency in services and claim compensation from the builder.
