How to claim property as per Hindu Succession Act
11-Oct-2023 (In Property Law)
1. An aged couple dies (intestate) leaving behind 1 married son & 1 married daughter as their only legal heirs 2. Ornaments belonging to the couple are amicably distributed between the legal heirs, without documentation, and used eversince, uninterruptedly, by the respective family members of the legal heirs. 3. The married son & married daughter each have separate & independent families, without any financial or asset oriented tie-ups ( by way of joint a/c;etc). 4. Say after 20 yrs therefrom, the wife of the married son leaves for heavenly abode leaving behind her husband (i.e. the married son) & their only son being the only legal heirs. >QUESTION:At a future date of further 8 yrs therefrom, can said married daughter/any of her family members (with malafide view to snatch ornaments from married son/son of married son, on the pretext that wife of married son had left for heavenly abode, & her son unmarried) put any lawful & valid claim against them?(note:no docs either party)
Sir
No, she cannot bring any valid claims over the ornaments.
Already many years have passes and ornament went from one generation to another, and now if she brings any cliam that will be hard for her to prove in the court of law.
