How to claim for property when the elder generation is dead

My father is no more and I have to do a partition of property papers among my grandfather and his brother's generation (both are dead). I and my uncle are successors for our hairlines. Being helpless my paternal aunts are also demanding, despite of getting property as dowry during their marriages. They have become grandparents. How do I approach the court with my mother who is govt. Employee after father's death. M not married yet. Hiw to proceed?

For filling partition suit it does not matter who is alive or dead.. Their will be complete partition. So you can file a partition suit before civil court of your district by making parties to surviving member of your family.
