How do we sell flat to new buyer if we do not have chain of agreement

we had inherited from our parents flat.after he passed away.we could not find chain of agreement and also not on society record. what is the proceedure as it was purchased by parents in 1985. how do we sale to new buyer.

If you have registration no of the concerned documents then do apply concerned sub-registrar office for certified copy of the same. If you don't have the registration number then you have to take search of Index II record in the concerned sub-registrar office for respective years.

My Response to your query :

You have to go through the record prior to 1985.
Original land transfer.
Registration for flat with society and corporation.
PR Card.
PTR card.
Map.
Share certificate if any.
Society NOC.

This is my response to you:
1. Since the chain was not found you must approach the Registrar;
2. You should engage services of lawyer and obtain a title search report;
3. You must also file a police complaint that the originals are not traceable;
4. Then you must make an advertisement in the newspaper (3 newspaper including national and local) and invite claims on the property;
5. After taking all the precautions then only the new buyer will purchase.

before 1995 original documents are not been handover immediately to the executants like these days. You may get it in the concern Registrar Office, else you have to follow the procedure of missing documents, such as lodging of F.I.R., Public Notice in News Paper, procurement of certified copies from the Registrar Office,etc.

There must be some document with you else how can you say that you have inherited the flat ?
The new buyer will surely require three chain of documents and that too the original documents else who will buy such property without documents ?
No buyer will take risk of buying property without original documents as there is probability of litigation if the original documents are in possession of some other person.
