Got the flat other than what is promised , can I sell it

i bought a 3bhk flat in baroda from a known person. he broke his bungalow and constructed 3 floor appartment. he stays on 1st, i stay on 3rd. I found out that the 3rd bed room is illegally constructed. the drawing shows only 2 bhk. i asked him to change by deed to 3bhk, he has done it. i am asking to regularise the drawing, he says he cant. also this is not a society, now my flat leaks from all sides. he says we shall use the maintenance amount for repair (big amount has been quoted). how can i get the drawing regulated. i want to sell the flat. how can i do that in this circumstances.
Firstly, you can not regularise your flat now,
If it's true that your flat is not constructed as per map passed by VUDA then you can claim for damages and file police complian for charting.
If you want to sale your flat then you can sale it.( if you have a sale deed)
