Gifting of ancestral property to 2 child and not me (daughter)
08-Oct-2023 (In Property Law)
I m the youngest daughter(married) of my father and I have 1 brother and 1 elder sister. My father gifted his entire property to two of them and not me.My father obtained the property from his father(my grandfather) as a heir.My father had not taken any NOC from me.Can anything be done to take my share? I ve recently heard about the supreme court verdict on daughter claim to father property....whats tht?
Yes you can claim your right in the property. The recent judgement is also in your favour. Rest there are many verdicts of supreme court in relation to share in ancestral property. The law is somewhat different as the property is ancestral. I need to see documents for further advice on the matter. Also the gift deed has to be challenged to obtain your right of share in the property. The same should be done immediately with no delay as your father has already gifted the property. Delay in such cases give it adverse effect. Contact me for further discussion and better advice in the matter.
