Gift deed made without Owners will what to do
21-May-2023 (In Property Law)
Mother is the absolute owner of the property and she made Will deed in 2008 to elder Son and later in 2017 another son made gift deed on the same property without her mother intervation and claiming the property. Mother is still alive and elder son died. Can the elder son's heir claim the property? Or can suit file against him.
It is not clear from your property as to who is owner of property and how the property was acquired. The question of "will deed" doesnt arise as your mother is alive and the will" comes into existance after death. During her lifetime, if the property was transferred it can be set-aside by filing a suit.
