Father started construction on government property without permission

When he was in service he buyers a site and constructed house in my mother name with out taking permission from government To Day my mother made gift deed to my younger sister Is it any right or possibly to claim in court Other BENAMI act will apply for this property

No, your father had no right over the property at the time of construction of the building. Now the gift deed stands void abi nitio as the property is a government land and not of your father or mother. Secondly there can be a case against your father for illegal possession of the government land.
