Father passed away want to claim my share in his property
21-Dec-2023 (In Property Law)
What happens when a Father has passed away (The mother has passed away too) leaving behind his 3 daughters of whom the first 2 have already got their respective share from his two separate properties (one property each) and the youngest of the 3 is left only in possession of the fathers last asset (intestate property) which is under her possession but not been transferred to her name . All his properties are self acquired.
The one property which is the last piece n in possession of that one daughter is still open for intestate succession of all three daughters. But however it depends on mutual harmony between 3 sisters wherein the two have to agree to have received individual property n relinquish their right over this property. Failing which your have to fight n establish that they are not entitled and only you are entitled based on your possession n they being given other individual property respectively.
