Eviction of tenant from commercial property due to non payment of rent

We rented our shop 20 years ago. Only during initial couple of years we had a lease agreement for 11 months, after about 10 years the tenant's son took over the shop from his father, however stated paying rent but for the past 10 months he stopped paying rent and when ever asked for rent he would tell us he would vacate the shop and stayed there until the advance amount got exhausted ( there is no written document for the advance amount ) however last month he shifted his business elsewhere and locked the shop and now demanding money to vacate and handover keys to the shop.

first of all we need to give legal notice to tenant's son stating that you have to pay outstanding rental dues for the months due and then if there is no proper reply then u can take action by filing case against him for recovery of dues.
