Evicting tenant without lease agreement - Mumbai

My father has given our commercial property on rent around 2 years ago. Earlier there was a rent agreement but that is expired. My Father expired in October 2018. Property is still at my father name but I have received NOC from my brothers to transfer property on my name.
I tried to vacate the property from the tenant but he is not ready to vacate and he is also not paying rent. From last 6 month I tried to meet him and resolve the issue but he never responded properly. Now he is asking 5 lac to vacate the property by saying he has given heavy deposit to my father.
As I know, deposit was only Rs. 30000 and rent was 9000. I don't have old agreement copy so I don't have any proof to prove him wrong.
Please suggest the best possible ways to vacate the property without any hustle.
