Does one have to pay GST for under construction flat?

Hello sir, I took a flat in Patna on CLP basis & taken home loan from Lic HFL on Feb 2016. The registered Agreement was done in Patna court. As per agreement the proposed date of flat handover was March 2017. But when I visited the site it was not completed. They verbally told me that we will handover in June, again I visited the site it was not completed. This time they said that your flat will be handover by September end. Till time they took 95% money from me. Now yesterday they called me & said that you have to pay GST @12% of whole flat vallue before final registry. Total flat vallue is 39 Lacs. Now they are saying if you will not pay the same we will send you notice. I am much worried plz help me what I should do ????

Though I am not Tax lawyer, but even as per GST law , your builder can only raise GST on the amount remained to be paid after commencement of GST. GST has no retrospective effect. The builder can not raise GST on amount which had already been paid before coming into effect of GST.
