Discrepancy in patta measurements and survey number of land
29-Apr-2023 (In Property Law)
I am in the process of screening a CMDA approved land for buying. In that due course I noticed the following points. a) The seller has applied for patta recently and obtained it only last week. On verification it is found that there is a deviation of land measurement mentioned in the patta against sale deed & layout ( 400 sq ft is missing in patta) why there is such a huge deviation ? do the correct dimension should be specified in the patta? Will there be any problem later for me if there is such a huge deviation? b) The survey numbers mentioned in the sale deed document is not matching with new patta obtained. What might be the reason ? does it need any rectification ? c) In patta the land is mentioned as Nanjai. Will there be any problem for the building approval process?
There should not be any inter se discrepancies among the various documents such as sale deed, patta and EC. Ask the promoter to give you proper explanation. If the reply is not satisfactory, better call off the deal.
What if the measurement in the sale deed is wrong?
If you find errors in the sale deed, or any other document related to property, you can have a rectification (or deed) of rectification drafted and registered. This will nullify your mistake.
Can Patta be applied online?
Patta can be obtained online, or from the Taluka office where the Tahsildars of each district keep the Patta Chitta.
How can I correct my Patta spelling mistake?
If you want to correct the name of the patta on your passport, then you can apply for the correction at the Tahsildar concerned by submitting supporting documents like a Ration Card, Voter ID Card, Aadhar Card and any other acceptable proof. 03-Feb-2017
Will Patta change automatically after registration?
After the land is registered, pattas are automatically transferred to the name of the purchaser. Public does not need to apply for patta transfers or visit the Tahsildars office separately. 19-Jan-2023
Regarding the land intending for buying in which if there is any deviation of land measurement between patta and sale deed the authority will take that whichever is less in measurement for the building approval process. You can only reply upon the patta only because after the measurement of the land only the patta has been issued by the authority and subsequently you can verify the old survey number and also new survey number and if both the survey number in patta and sale deed are not matched you can go for rectification deed
You can apply to the Tahsildar office of your jurisdiction for corrections. You may also be able to get approval based on existing documents, if you submit a plan that discloses the site measurements.
