04-Oct-2023 (In Property Law)
HAVING PARTIAL O.C.;NO CONVEYANCEEXECUTED BY DEVELOPER/BUILDER AND DEVELOPER/BUILDER HAS NOT PAID PROP.TAX.IS IT ADVISABLETO GO FOR DEEMED CONVEYANCE, TWO FLOOR ARE OCCUPIED BY DEVELOPER/BUILDER AND ALSO NON-MEMBER.
This is my response to you:
1. Partial OC is for few floors what about other floors? What is the promised date?
2. You need to execute a deed of conveyance;
3. Otherwise go for deemed conveyance;
4. If partial OC is obtained then other flat owners are at risk;
5. if builder has not paid tax as well then municipal authority can send notice;
6. Consult a local lawyer and then only go ahead with legal steps.
